Telecom has welcomed the Commerce Commission’s decision to proceed with parts of the TelstraClear application on wholesale services and to reject other parts of the determination.
The Commerce Commission has determined that TelstraClear’s application did not meet the minimum standard of the Telecommunications Act where it sought wholesale access to Telecom’s retail bundles of services, or individual services that were parts of bundles.
Telecom’s General Manager Government and Industry Relations, Bruce Parkes, said the Commerce Commission stated that TelstraClear did not attempt to reasonably negotiate on bundles and that it did not state specifically enough what bundles they wanted to access.
“The Commission stated that it ‘has been unable to find any evidence of negotiation in respect of bundles of retail services’ (para 32),” Mr Parkes said.
“This is a strong message to Telecom’s competitors. The new regulatory process is not a substitute for genuine negotiation. It is not good enough to not negotiate, not specify what services are required and then rush off to the regulator.
“It is good to see the Commission making clear that it will not accept second rate standards from our competitors.”
Mr Parkes said Telecom remains available for negotiations with Telstra Clear over retail bundles.
